Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CALM SPARK WEB SOLUTIONS AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNTS YOU PAID US FOR SERVICES DIRECTLY RELATED TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, IF ANY. Indemnity
To the extent permitted by law, you agree to defend and indemnify Calm Spark Web Solutions and its owners, employees, and contractors against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
Changes
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Subject to applicable law, you agree that the state and federal courts located in California shall have exclusive jurisdiction over disputes arising from these Terms or the Site.
